5. What are the duties and powers of a peace officer? CCP 2.13: To preserve the peace within the
oflcer's jurisdiction. To ettect this purpose, the oflcer shall use all lawful means.

: When a high priority report is received alleging the immediate risḳ of physical and sexual abuse of a child that could

, lead to death or harm by the caregiver, the peace oflcer shall investigate jointly with the department or the agency conducting the
investigation asap but not later than 24hours after notification.
7. When can a peace officer ignore the 4th amendment and maḳe an arrest without a
warrant? CCP: The arrest can be made when the ottense is committed in the oflcer's presence or view. 14.01(b)
8. When can a citizen maḳe an arrest? CCP: Any other person, may, without a warrant, arrest an ottender
when the ottense is committed in his presence or within view if it is a felony or ottense against the public peace. 14.01 (a)
9. What is the difference between may and shall when maḳing an arrest?: "May" arrest
means it is at your discretion. "Shall" arrest means that you have to arrest.
10. How long is a protective order good for when not specified?: For the duration of the life of
the ottender and the victim or if not stated in the order, two years
11. How must a conviction be proven?: Beyond a reasonable doubt
12. How is racial profiling defined?: You may not select a suspect on account of race
13. How must the arrest be handled when a protective order is violated?: Peace must
maḳe the arrest when violation of protective order has been committed in plain view.
14. Who are not considered peace officers?: Special Investigators such as the FBI and the Secret Service.
