SECTION A — Trias Politica (Separation of Powers)
1. On what four assumptions is the trias politica based?
The classical trias politica (Montesquieu) rests on four core assumptions:
1. Functional separation: The state’s powers are separable into three distinct functions —
legislative (make rules), executive/administration (implement rules), and judicial
(adjudicate disputes).
2. Mutual checks and balances: Each branch must check the others to prevent
concentration and abuse of power.
3. Institutional independence: Each branch must be institutionally independent (different
organs, independent personnel) so that no single branch controls the others.
4. Rule of law & constitutional supremacy: Power exercise is constrained by law
(constitution), ensuring legality and protection of rights.
