The South African Constitution aims to ensure that all human rights are protected and aims to correct the inequality that existed in the history of South Africa. Human rights forms now the basis of everything we do. The Curriculum and Assessment Policy Statements (CAPS) curriculum that was developed aimed to get teachers to teach, promote and portray the human rights while teaching their subjects. It is important to see the direct link that the human rights and the constitution have on the curriculum of Life Orientation. The Life Orientation curriculum is therefore the critical basis of all teaching as this sets the stage the way you need to teach.

Human rights and the Curriculum and Assessment Policy Statement

Life Orientation Senior phase

, Wiredu (1996: 157) states, “human rights are claims that people are entitled to
simply by virtue of their status as human beings”.

The South African Constitution aims to ensure that all human rights are protected
and aims to correct the inequality that existed in the history of South Africa. Human
rights forms now the basis of everything we do.

The Curriculum and Assessment Policy Statements (CAPS) curriculum that was
developed aimed to get teachers to teach, promote and portray the human rights
while teaching their subjects. It is important to see the direct link that the human
rights and the constitution have on the curriculum of Life Orientation. The Life
Orientation curriculum is therefore the critical basis of all teaching as this sets the
stage the way you need to teach.

The Constitution and Bill of Rights are the foundational documents that are created
to law and govern a country. The Constitution is the law of the land, which states,
each person’s rights and responsibilities. The Bill of Rights is a list of rights that
everyone is entitled to. This is not earned and is regardless of a persons
background and upbringing.

There were many factors that contributed to the final formation of the Constitution
and Bill of Rights in South Africa.

Global events that took place, played a role in influencing the bill of rights formation.
Examples of these are: The English bill of rights formed in 1689; The American
Revolution (1775-1783); The French Revolution (1789-1799) and The Universal
Declaration of Human Rights in 1948.

Elenor Roosevelt created the Universal Declaration of Human rights in 1948 which
sparked global conversations about human rights and created a foundation for what
the human rights should be about in other countries.

South Africa’s first democratic election was in 1994 and the Constitution was
implemented in 1996. The Constitution in South Africa was based on two traditions,
the Western and the African.
