Question 1.

1. Draft the vesting clauses for the transferees listed below, as required by the
Deeds Registries Act 47 of 1937 and the regulations issued thereunder. You may
use your imagination for any missing details:

(a). A partnership where at least one of the partners is married in community of
property. ( 4)

Regulation 20(1)(f) requires the full names of partners, marital status, and
ID/passport details. If a partner is married in community of property, the spouse
must be disclosed.

Example Clause:

"ABC PARTNERSHIP, consisting of:

1. John Michael Peterson, identity number 720315 5043 084, married in
community of property to Sarah Peterson,
2. David Robert Smith, identity number 680921 5082 007, unmarried,
carrying on business in partnership under the name and style of ‘ABC
Partnership’, of 15 Main Street, Cape Town, Western Cape."

Notes:

 Partnership is not a separate juristic person; all partners must be named.
 Marital status and ID numbers are mandatory (Reg. 18(1)).



(b). A person who does not have a valid identity document. (3)

Regulation 18(1) — if no SA ID is available, give date of birth and passport or
other acceptable document number and country of issue.
