Question 1
Claiming Possession through the Rei Vindicatio
Evergreen Printing, under the ownership of Mr Mboweni, may initiate a legal process to
recover its printing machine and compressor from Mr Viljoen’s property by instituting a
rei vindicatio claim. This legal remedy in South African property law empowers the
rightful owner to reclaim their property from someone who is unlawfully possessing it
(Scott, Property Law Study Guide, p. 90).
To succeed, Evergreen must prove the following:
1. That it is the legal owner of the printing machine and compressor.
2. That the equipment in question still exists and can be individually identified.
3. That Mr Viljoen or USS Graphics is in unlawful possession of the items (Scott,
Property Law Study Guide, p. 91).
Because ownership in property law is a real right enforceable erga omnes (against the
entire world), Evergreen retains the legal authority to demand return of its property from
any party—so long as the property has not undergone legal accession (become part of
another object). This principle was affirmed in the case of USS Graphics (Pty) Ltd and
Others v Urban Print Factory (Pty) Ltd and Others [2023] ZAGPJHC 138, para 10.
If Evergreen can establish its continued ownership, prove that the equipment has not
become part of the property through accession, and show that it is being unlawfully
held, the rei vindicatio is likely to be successful.
