, Emergency psychiatry is situated in the center of the conflicting concepts of autonomy and

liberty, which must be carefully weighed against mental diseases that undermine autonomy and

increase the likelihood of aggression as well as suicide. While all branches of medicine must

comply with legal regulations, emergency psychiatry is especially bound and directed by federal

and state regulations (Rozel, Toohey & Amin, 2023). According to Brenner and Robey (2024),

emergency psychiatric care encompasses various routine procedures such as involuntary

assessment, admission, and treatment, as well as the management of agitation, medical

stabilization, and transfer. These activities are conducted within specific legal boundaries, rules,

and processes, which also address issues of confidentiality, voluntary and involuntary

commitment, and obligations towards third parties.


Explanation on the New Jersey’s state laws for involuntary psychiatric holds for child and

adult psychiatric emergencies

In New Jersey, a person can be detained against their will for psychiatric assessment if

they present a danger to others as well as themselves because to their psychological state. A

forced hold may be undertaken by either a law enforcement official or an emotional health

screener, typically a certified psychiatric healthcare professional. The first duration of the hold is

limited to a maximum of seventy two hours, following which the individual is assessed to

ascertain the need for further treatment. The healthcare professional or a designated professional

overseeing the hold is given the power to lift the emergency hold if they ascertain that the subject

subsequently does not presents a threat to himself or others and no longer needs additional care.

If the attending physician deems it necessary, they might petition for a court hearing to extend

the involuntary commitment of the subject. After the hold is lifted, the individual can be released
