Mandated Reporting: Child Abuse
severe neglect - severe malnutrition, medically diagnosed non-organic failure to thrive,
intentional failure to provide adequate food, clothing, shelter, or medical care which endangers
health
severe physical abuse - large burn, CNS injury, abdominal injury, multiple fractures, life
threatening abuse
sexual assault - includes: rape, statutory rape, rape in concert, sodomy, lewd or lascivious acts
upon a child, oral copulation, sexual penetration, child molestation
sexual exploitation - conduct involving matter depicting a minor engaged in obscene acts,
Conduct includes preparing, selling, distributing, & downloading/streaming for personal use
state to report to - CA--regardless of where the abuse was purported to have taken place. It is
up to the reporting agency to handle notifying any other out of state agencies as needed
under 14 / significantly younger and sexual naivete is being exploited - sexual activity is
reportable
under 16 / over 21 - consensual sex (vaginal, oral, anal) is reportable
when to report - when operating in one's professional capacity, if one has knowledge or
reasonable suspicion of child abuse or neglect; can be second or third-hand information
written report - 36 hours, on DOJ Suspected Child Abuse Reporting forms
younger than and above - consensual sex & sexual activity is reportable
, 14 or 15 / an adult 10 years older, as determined by birth dates - consensual sex is reportable
any forced or coerced sex involving a minor who was not a willing participant - reportable
child effected by domestic violence - reportable as CHILD ABUSE (not DV) if causes child
unjustifiable mental suffering, endangers his/her health or person
child's right to sue for failure to report - statute of limitations goes into effect once child reaches

confidentiality - mandated reporter may only break confidentiality to disclose directly to the
reporting agency and respond to follow-up inquiries

domestic violence (minor witnessing or not) - in and of itself, NOT a mandatory report
downloading, streaming, or digitally accessing a sexual image of a minor - reportable
failure to report child abuse (civil) - cost of subsequent damage or injury from abuse (including
delayed onset symptoms years later).
failure to report child abuse (criminal) - misdemeanor: $1,000 fine and/or 6 mo. county jail
