QUESTION 1: CIVIL PRACTICE (50)
QUESTION 1.1
(a) Type of summons to recover the outstanding amount (4 marks)
In this case, a combined summons must be used by Shiny Plastics. A combined
summons is appropriate where the cause of action is based on a debt or liquidated
demand, but evidence and legal arguments may be needed to prove the claim.
• The claim is for R300,000.00, a fixed and ascertainable amount, arising from the
delivery of goods (plastic bottles) pursuant to an agreement.
• However, as disputes of fact may arise (e.g., quality of goods, delivery, etc.), a
combined summons, which includes a particulars of claim, is the suitable
procedure under Rule 17 of the Uniform Rules of Court.
