What is "Pleadings" and what is included in it? - answer Pleadings are document
asserted in a proceeding called an "action". Includes: 1) statement of claim 2) statement
of defense 3) reply 4) other pleadings like counter claims
What is an affidavit of documents? - answer When each party swear an affidavit that all
the relevant docs that are in their possession and control have been listed.
What are the 3 approaches to ADR? - answer1. Information: rely on someone else to
process info and bring back to the parties (e.g. valuation by neutral expert)
2. Consensual: the parties have right to accept/reject the outcome that come about by
their own agreement (mediation)
3. Adjudicative: Arbitration - decision making power is delegated to 3rd party

What is the difference between fact vs. opinion witness? - answerFact witness - Only
