Fifth Amendment - Answer-No person shall be held to answer for a capital, or otherwise
infamous crime, unless on a presentment or indictment of a grand jury, except in cases
arising in the land or naval forces, or in the militia, when in actual service in time of war
or public danger; nor shall any person be subject for the same offense to be twice put in
jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness
against himself, nor be deprived of life, liberty, or property, without due process of law;
nor shall private property be taken for public use, without just compensation.

Search - Answer-An intrusion or entry by an agent of the government on a quest for
evidence into an area where a person has a reasonable expectation of privacy
Reasonable suspicion - Answer-The belief by a reasonable and prudent person based
on the articulable facts, that something has happened
Probable cause - Answer-The level of suspicion that would cause a reasonable and
prudent person, given the overall circumstances, to believe a crime has been committed
Frisk Search - Answer-A crushing and passing over of the outer clothing of a person in
search of a weapon
-Extends to immediate grab area
-Must have reasonable suspicion
Search Incident to Arrest - Answer-A search following an arrest of an individual,
searching for weapons, evidence and means of escape
-Extends to immediate grab area
-Must have probable cause
Detention - Answer-The act of keeping back, restraining, or withholding a person or
property for a temporary, reasonable period of time for the purpose of inspection,
investigation, or search when such act does not amount to an arrest of seizure
Commandant's Use Of Force Policy - Answer-Only that force reasonably necessary
under the circumstances may be used. Force shall not
be used where assigned duties can be discharged without it. Excessive force may never
be used; however, nothing in the application of the Coast Guard Use of Force Policy
shall be construed as to require personnel to meet force with equal or lesser force.
4 Types of Subjects - Answer--Passive Compliant: A subject who follows the officer's
request and verbal directions

directions, but offers no physical resistance to the officer's attempts to gain control
-Active Resistance: A subject who does not follow the officer's request or verbal
directions and offers physical resistance that prevents or may prevent the officer from
gaining control but does not try to harm the officer
-Active Aggressor: A subject who attempts to harm or attack the officer
Level 1 Officer Presence - Answer-Appearance, demeanor, verbal and non-verbal
communications that create an atmosphere of compliance
Ex. PDW, Baton, Uniform, Interview Stance, Boarding Platform, LE Lights/Siren, Voice
Inflection/Tone
Level 2 Verbal Commands - Answer-Verbal communications in the form of task
direction with consequence aimed at the subject
Ex. "Step away from the hatch or you will be subject to fines and arrests"
"Put your arms out to your side or you will feel pain."

Level 3 Control Techniques - Answer-Techniques or actions with a low probability of
causing connective tissue damage, lacerations of the skin, or broken bones. These
techniques include the proper use of restraint devices and pain compliance and strength
techniques.
Ex. Escort Position, Transport Wristlock, Pressure Points, Normal Handcuff Application
Pressure Points - Answer-Infra-orbital, Hypoglossal, Mandibular, C-Clamp, Jugular
Notch
Level 4 Aggressive Response Techniques - Answer-Techniques or actions likely to
result in connective tissue damage, lacerations of the skin, or broke bones, or that will
produce irritation to the skin, eyes, and/or mucous membranes. These techniques
include the proper use of kicks, stuns, punches, takedowns and chemical irritants.
Ex. OC Spray, Straight Punch, Front Jab, Elbow Strike, Palm/Heel Brachial Strike,
Inner/Outer Forearm Strike, Suprascapular Stun, Forearm Strike, Knee Strike, Angle
Kick, Front Snap Kick, Superficial Personnel Kick, Straight Arm Bar Takedown
Chemical Irritant - Answer--Spraying a subject too close may cause ballistic needle
effect which may lead to serious physical injury
-Used to prevent reactionary gap from closing
-Used for multiple subjects
-Best to spray at least 10' from the subject
