Introduction

The issue of restrictive abortion laws in the Republic of Liberte has become a matter of great
concern in the international community. The case of Agibu, a 13-year-old girl who was denied

an abortion after being repeatedly raped, highlights the urgent need to address the violation of

women's reproductive rights in Liberte. As an expert in human rights, it is my duty to provide a
legal opinion for the African Centre for Women Justice (ACWJ) on the possibility of instituting
legal proceedings against the Republic of Liberte before the African Court on Human and
Peoples’ Rights (The African Court).




Procedural Issues regarding Admissibility of Cases before the African Court

Before addressing the substantive legal issues, it is important to consider the procedural

aspects of this case. The African Court has jurisdiction to hear cases brought by individuals and
non-governmental organizations against state parties to the African Charter on Human and
Peoples’ Rights. It is essential that the ACWJ carefully follows the admissibility criteria set out in

the Protocol to the African Charter on Human and Peoples’ Rights on the Establishment of an
African Court on Human and Peoples’ Rights.
