Copyright Case Study
"Author's right," sometimes known as "copyright," is a legal phrase referring to the ownership rights that writers and artists have over the creative works they have produced. Under copyright law, many jobs may remain protected—everything from literature to movies to sculptures counts. Intellectual property laws safeguard copyrighted works of authorship, including literary, theatrical, musical, and aesthetic works. Some examples of unique creative expression include poetry and books, cinema; music; computer programming; and architectural design.No real facts, ideas, operating systems, or operation methods remain protected from infringement under intellectual property law. To put it another way, this implies that copyright protection begins when your work is produced and placed into a concrete form that can be seen or heard. According to Kalimo at el.(2018), the fair use doctrine does not protect how Cougar uses the company logo on the highlight films. This is since the doctrine of fair use protects four distinct types of reproduction or utilization of works. The works that have remained reused without permission, a license, or consent should fall under criticism, commentary, news reporting, teaching, scholarship, and research. If the work being reused does not fall under these categories, then the work in question cannot be said to be protected by the fair use doctrine. In this instance, the films that stood out the most did not fall into any of the abovementioned categories. Instead, the logos used remained included in a highlight reel that will ultimately be used for commercial purposes by the Cougars. As a result, the liability for infringing the copyright of Clark continues to rest with the Cougars. According to Chauhan and Willett (2019), Cougar's argument that the United States Congress does not have the jurisdiction to regulate copyright within the boundaries of a single state is false. According to the United States Constitution's Trade Clause, intrastate and foreign commerce may remain held by Congress. Commercial transactions between residents of one state and residents of other states can only remain regulated with limited authority. On the other hand, this is not the case. This clause has only contributed to the complexity of the laws and has granted the absolute right to regulate specifically commercial infractions as they are. Even in a single state, it is against the law to unauthorized use someone else's intellectual property. In addition, it has been proven beyond a reasonable doubt that Clark's work remained used in this instance without his permission. In the event that it remains determined that the Cougars' use of the logo in highlight films constitutes an infringement, it can and will remain established once more. Trade secrets, patents, trademarks, and copyrights are the four main divisions that can remain found in the United States Constitution that protects intellectual property rights. This is something that we know for a fact. Anything that fits into one of four categories and remains reused without permission or a license will be considered an infringement of copyrights and subject to legal action.
