Unit 3 – P4: Describe the elements of specific nonfatal offences

Introduction

This assignment has the aim to illustrate the different elements of specific non-fatal offences such as
Battery, ABH and GBH. It is crucial to understand that the Actus Reus and Mens rea are the fundamental
component of these elements as the Judges analyse a case in accordance to Actus Reus and Mens Rea. I
have endeavoured to include as many case laws as I could in order to demonstrate the importance of
the case law in establishing the law. More importantly, for each element, I have created a scenario
where Actus Reus and Mens rea of the cases are explained. At the end of this assignment, there is a
comprehensive comparison between Battery and GBH and The differences and similarities were
thoroughly analysed with also comparing the cases as well as the scenarios.




This statistics demonstrate the changes in data of young people committing GBH without intention from
210 to 2013. As it is shown, the GBH crimes committed by young people have significantly reduced from
over 1,000 in 2010 to less than 600 in 2013. This is non-London areas. However, the London’s GBH
convictions has also reduced but not as much as non-London areas. However, the total number of
defendant committing GBH in non-London areas have always been higher and are still higher as you can
see 600 crimes in on-London areas in comparison to less than 400 in London. Moreover, the total trend
of wounding with intent or malicious by young people has slightly reduced from over 1200 in 2010 to
less than 900 in 2013.
