Do you recommend criminalizing healthcare errors as an effective approach to holding
healthcare providers accountable for their mistakes? Why or why not?

While I do believe one should be held accountable for their mistakes, I don’t think criminalizing
someone for an error is the best approach. Unless this was a known mistake, that went
unspoken of, that led to a fatal outcome. While holding one accountable for their mistakes is
imperative, criminalizing errors could unfortunately lead to a culture of fear, close off open
communication, and cause a decrease in reporting of errors. If mistakes were to be
criminalized, this could hinder learning opportunities and areas for improvement within
healthcare systems.

How can healthcare providers balance the goal of high-quality care with the potential risks
and consequences of errors?

One way that healthcare providers can balance high-quality care with the risk and
consequences of errors is following standardized protocols. Often, healthcare systems have
these in place, that implement evidence-based guidelines to reduce inconsistency in care and
minimize errors. Implementation of reporting systems can allow one to report errors, without
the fear of retribution. At the healthcare system where I am employed, all employees have
access to a reporting system, these go to management of the affected unit and quality care
teams. More times than not, feedback is given to staff from these reports and changes are
implemented to ensure high-quality, safe care is provided to patients. One can also engage
patients and their loved ones to be involved in their care. This can enhance safety and informed
patients/family members can help identify potential issues.

Are current legal and regulatory frameworks adequate to address healthcare errors? If so,
why? If not, what changes are necessary to ensure the regulations best serve clients and
providers?

Current legal and regulatory frameworks are often inadequate to fully address healthcare
errors. There is significant inconsistency in how errors are reported and managed across
different states and institutions, leading to inconsistent accountability and learning
opportunities. Many existing laws focus on punitive measures rather than fostering a culture of
learning and improvement. As mentioned before, this can deter healthcare providers from
reporting errors. Current regulations do not sufficiently incorporate patient perspectives or
engage them in safety practices, which can lead to missed opportunities for error prevention.
There are several changes that can be implemented to ensure these regulations best serve
clients and providers. The establishment of systems that encourage non-punitive reporting of
errors can help create an environment where healthcare providers feel safe discussing mistakes.
Also developing regulations that actively incorporate patient feedback, and involvement can
enhance safety and improve care quality. By addressing these gaps, legal and regulatory
frameworks can become more effective in promoting accountability and improving patient
safety in healthcare settings.
