1.1(a) Legislation applicable to the eviction
National Building Regulations and Building Standards Act 103 of 1977 (NBRBSA).
Section 12 of the Act deals with buildings or structures that are unsafe or unhealthy. In
particular, section 12(4)(b) empowers the local authority to order the vacation of a
building where this is necessary for the safety of persons.

1.1(b) Authority responsible for ensuring that unsafe buildings are made safe
The local authority/municipality has the authority to ensure that buildings within its
jurisdiction that are unsafe or unhealthy are altered or renovated so that they become
safe and suitable for human occupation.
In this scenario, that authority is the City of Tshwane Metropolitan Municipality.
Section 12 enables the local authority to require an owner to take steps to make an
unsafe building safe.
