, EMTALA- Emergency Medical Treatment and Labor Act was passed in 1986, it states that

peoples coming with emergency medical conditions gets proper screening, stabilizing

treatment, or transfer—despite of their financial status or mode of transport. (Clark 2025).

EMTALA ensures access to emergency care and prevents hospitals from refusing treatment or

transferring patients based on financial considerations. EMTALA is enforced by the Centers for

Medicare & Medicaid Services (CMS), the Office of Inspector General (OIG), and federal courts.

Hospitals are responsible for administering the policy through required screening exams,

stabilization procedures, and appropriate transfers. Enforcement includes audits,

investigations, and potential civil monetary penalties for noncompliance. EMTALA benefits

uninsured individuals, low-income populations, undocumented individuals, and those lacking

access to primary care by ensuring they receive emergency medical evaluation and

stabilization. Hospitals, clinicians, and payers may experience financial strain because

emergency services must be provided regardless of reimbursement. EMTALA promotes health

equity by guaranteeing equal access to emergency treatment; however, it does not directly

address disparities in preventive or long-term care. Research shows that EMTALA was enacted

to address “patient dumping,” a term used to describe when a hospital transfers uninsured or

underinsured patients or denies care for financial reasons. Studies have revealed ongoing

challenges, including emergency department crowding and resource strain; however, EMTALA

remains essential in protecting access to emergency medical care (Schultz et al., 2024; Warby et

al., 2023).
