Principles Governing the Choice of Municipal Service Delivery Mechanisms

Introduction

Municipalities play an important role in improving the quality of life of communities by
providing essential services such as water, sanitation, electricity, refuse removal, roads
and other municipal services. In South Africa, municipalities are required to provide
these services in a manner that is sustainable, affordable, equitable and responsive to
the needs of local communities. However, a municipality does not necessarily have to
provide every service directly through its own administration. The legal framework
allows municipalities to choose from different service delivery mechanisms, depending
on their circumstances, resources and capacity. The main framework governing this
choice is found in the Constitution of the Republic of South Africa, 1996 and the
Local Government: Municipal Systems Act 32 of 2000 (MSA).

The choice of a service delivery mechanism is therefore not simply a matter of political
preference. A municipality must consider a number of legal, financial, administrative,
social and developmental principles before deciding how a particular service should be
provided. Sections 76 to 78 of the Municipal Systems Act provide a structured
framework for making such decisions.

Principles that must be considered when choosing a service delivery mechanism

The first important principle is that municipal services must be provided in a manner that
promotes equitable and sustainable service delivery. Section 152 of the Constitution
establishes the developmental objectives of local government, including providing
democratic and accountable government, ensuring sustainable service delivery,
promoting social and economic development, promoting a safe and healthy
environment and encouraging community participation. Therefore, the municipality must

, select a mechanism that is capable of achieving these objectives rather than merely
choosing the cheapest option.

The principle of accessibility and affordability is also important. Municipalities must
progressively ensure that communities have access to essential services. The Municipal
Systems Act seeks to ensure universal access to essential services that are affordable
to all. This means that a municipality should consider whether the proposed mechanism
will enable poor and vulnerable members of the community to obtain the service. A
mechanism that produces a technically efficient service but makes the service
unaffordable to large sections of the community may not satisfy the municipality's
developmental responsibilities.

Another important principle is cost-effectiveness. Section 78 of the Municipal Systems
Act requires the municipality to assess the direct and indirect costs and benefits
associated with providing the service internally. The assessment must also consider the
effects of the mechanism on the environment and on human health, well-being and
safety. Consequently, a municipality should not merely compare the financial price of
different options. It should consider the broader economic, environmental and social
consequences of each option.

The municipality must also consider its existing and future capacity. Section 78
requires an assessment of whether the municipality has, or can develop, the necessary
skills, expertise and resources to provide the service through an internal mechanism. It
must also consider whether reorganising its administration and developing its human
resources could enable it to provide the service effectively. This principle is particularly
important because a municipality should not choose direct provision where it lacks the
technical, financial or human resources necessary to maintain an acceptable standard
of service.

Community participation is another fundamental principle. Local government in South
Africa is intended to be developmental and participatory. Communities must therefore
have an opportunity to express their views, particularly where a municipality is
