Reasonable Suspicion - Answer A standard used in criminal procedure. Looser than probable
cause. It is sufficient to justify brief stops and detentions, but not enough to justify a full search.
When determining reasonable suspicion, courts consider the events leading up to the brief stop
and decided whether these facts, viewed from the standpoint of a reasonable police officer,
amount to reasonable suspicion.
Probable Cause - Answer Requirement found in the 4th Amendment, that must usually be met
before police make an arrest, conduct a search, or receive a warrant. Courts usually find
probable cause when there is a reasonable basis for believing that a crime may have been
committed, or when evidence of the crime is present in the place to be searched. Under exigent
circumstances, probable cause can justify a warrant less search or seizure.
Vehicle Pursuit - Answer Active attempt by an officer operating a police vehicle to apprehend
an operator of a motor vehicle who, having been given a visual and audible signal by the officer
directing such operator to bring the vehicle to a stop, fails to obey such direction and either
increases the vehicle speed, extinguishes the vehicles lights or makes some other overt action
designed to avoid apprehension.
Arrest - Answer The act of depriving a person of their liberty usually in relation to the
purported investigation or prevention of crime and presenting to a procedure as part of the
criminal justice system.
Objectively Reasonable - Answer the true - and most accurate- legal standard when both
teaching use of force, and/or evaluating an officer's past use of force. Using any other standard
is avoidable dangerous because it is a false legal standard and can be easily misinterpreted or
misrepresented- either knowingly or not.
