SECTION 1: KEY FEDERAL REGULATIONS
All Major Laws Tested on the NMLS MLO Exam

1.1 SAFE Act — Secure and Fair Enforcement for Mortgage Licensing Act (2008)
The SAFE Act was enacted by Congress to establish minimum standards for the licensing and registration of
mortgage loan originators nationwide, reduce fraud, and enhance consumer protection.

Licensing Requirements:
• All MLOs must be licensed through NMLS (Nationwide Multistate Licensing System & Registry) or registered if
working for a federally chartered institution
• Must complete 20 hours of NMLS-approved pre-licensing education (PE) before applying
• Pre-licensing breakdown: 3 hours federal law, 3 hours ethics (including fraud, consumer protection, fair
lending), 2 hours non-traditional mortgage products, 12 hours elective
• Must pass NMLS National Test Component with a score of 75% or higher
• Background check required: criminal history, credit history, regulatory actions
• Cannot be convicted of a felony involving fraud, dishonesty, breach of trust, or money laundering — ever
• Non-fraud felony convictions: 7-year bar from the conviction date
• Must have a surety bond and errors & omissions (E&O) insurance (varies by state)

Continuing Education (CE):
• 8 hours of NMLS-approved CE required every year to renew license
• Breakdown: 3 hours federal law and regulations, 2 hours ethics (including fraud, consumer protection, fair
lending), 2 hours non-traditional mortgage products, 1 hour elective
• MLO cannot take the same CE course two consecutive years and get credit
• CE must be completed by December 31; most states require renewal by December 31
• Newly licensed MLOs: "Safe Harbor" — if licensed in one state and applying in another, may be temporarily
authorized pending full licensure

Exam Retake Rules:
• 1st and 2nd failures: must wait 30 days before retesting
• 3rd failure (and beyond): must wait 180 days before retesting
• If license lapses more than 5 years: must retake and pass the test again

Unique Identifier / NMLS ID:
• Every MLO must include their NMLS unique identifier on all loan documents, loan applications, and
advertisements
• NMLS ID must be disclosed whenever requested by consumer
• Failure to disclose NMLS ID is a violation

EXAM TIP: The SAFE Act applies to state-licensed MLOs. Federally chartered bank employees
TIP
are REGISTERED (not licensed) through NMLS — they do not need to take an exam.

1.2 RESPA — Real Estate Settlement Procedures Act (1974, Regulation X)
RESPA is administered by the CFPB and applies to federally related mortgage loans on 1-4 family residential
properties. Its primary goal is to eliminate kickbacks, referral fees, and hidden costs in real estate transactions.

Key Prohibited Practices:
• Kickbacks: giving or receiving anything of value (money, gifts, services) for referral of settlement service
business — ILLEGAL
• Fee splitting: dividing a fee with someone who did not perform services — ILLEGAL
• Unearned fees: charging for services not actually performed — ILLEGAL
• Seller-required title insurance: seller cannot require buyer to use a specific title company as a condition of sale
— ILLEGAL
• Controlled Business Arrangements (CBA): allowed only if: (1) written disclosure given, (2) consumer not
required to use the affiliated service, (3) no referral fees paid beyond ownership interest

Required Disclosures Under RESPA:
• Loan Estimate (LE): must be provided within 3 business days of receiving a complete application (replaced GFE
under TRID)
• Closing Disclosure (CD): must be provided at least 3 business days before consummation (replaced HUD-1
under TRID)
• HUD Special Information Booklet: required for purchase transactions only — provided within 3 business days of
application
• Mortgage Servicing Transfer Notice: 15 days BEFORE transfer by current servicer; 15 days AFTER by new
servicer
• Annual Escrow Account Statement: servicer must provide annually

Escrow Account Rules:
• Initial escrow deposit: lender can collect up to 2 months of escrow payments as cushion
• Escrow shortage: lender must allow borrower to repay over at least 12 months
• Escrow surplus over $50: must be returned to borrower within 30 days of annual analysis
• Escrow surplus under $50: lender may credit toward next period

RESPA Penalties:
• Criminal: up to $10,000 fine and/or 1 year imprisonment per violation
• Civil: borrower can sue for 3 times the amount of the kickback or fee paid

1.3 TILA — Truth in Lending Act (1968, Regulation Z)
TILA requires full disclosure of the true cost of credit. Administered by CFPB. Applies to consumer credit secured by
real property.

Required Disclosures:
• Annual Percentage Rate (APR): must be disclosed; represents the true cost of borrowing including interest and
certain fees
• Finance Charge: total dollar cost of borrowing (interest + certain fees)
• Amount Financed: loan amount minus prepaid finance charges
• Total of Payments: total amount to be paid over life of loan
• Payment Schedule: number, amounts, and timing of payments

Right of Rescission (3 Business Days):
• Applies ONLY to non-purchase transactions secured by borrower's primary residence
• Includes: refinances, home equity loans (HELOCs), home improvement loans
• Does NOT apply to purchase loans or investment property loans
• Rescission period: 3 business days from consummation, delivery of rescission notice, or delivery of all material
disclosures — whichever is latest
• Business day for rescission = all calendar days except Sundays and federal public holidays
• If lender fails to provide proper rescission notice, right of rescission extends to 3 YEARS

HPML — Higher-Priced Mortgage Loans:
• 1st lien: APR exceeds APOR (Average Prime Offer Rate) by 1.5% or more
• Subordinate lien: APR exceeds APOR by 3.5% or more
• HPML requirements: escrow account required for first 5 years, appraisal required, ability-to-repay must be
verified
• HPML rules restrict prepayment penalties and balloon payments

High-Cost Mortgage (Section 32 / HOEPA):
• 1st lien: APR exceeds APOR by 6.5% or more
• Subordinate lien: APR exceeds APOR by 8.5% or more
• OR points and fees exceed the greater of 5% of loan amount or $1,092 (2024 threshold)
• Restrictions: no balloon payments, no negative amortization, no prepayment penalty after 36 months,
counseling required

APR Tolerance Rules (TRID / Reg Z):
• Regular transactions: APR may change by no more than +/- 1/8% (0.125%) from LE to CD without triggering a
new LE
• Irregular transactions (ARMs, variable rate): tolerance is +/- 1/4% (0.25%)
• If APR changes beyond tolerance: new LE must be issued and 3-business-day waiting period restarts

1.4 TRID — TILA-RESPA Integrated Disclosure Rule (2015)
TRID replaced the Good Faith Estimate (GFE) and early TILA disclosure with the Loan Estimate (LE), and replaced
the HUD-1 Settlement Statement and final TILA disclosure with the Closing Disclosure (CD).

Loan Estimate (LE):
• Must be delivered or placed in the mail within 3 business days of receiving a complete application
• Borrower must receive LE at least 7 business days before consummation
• MLO cannot impose any fees (except a bona fide credit report fee) before delivering LE and receiving borrower
intent to proceed
• LE is NOT binding — it is a good-faith estimate
• Business day for LE = all calendar days except Sundays and federal public holidays

Closing Disclosure (CD):
• Must be received by the borrower at least 3 business days before consummation
• Business day for CD = all calendar days except Sundays and federal public holidays
