Red Wood (RW) supplies Furniture Manufacturers (FM) with wood for the
manufacturing of furniture. The members of Wood Employees Association
(WEA), employed by RW, decided to stop working action in support of
employees of FM who are in dispute with their employer regarding a new
promotion criterion. (a) Identify the nature of the action taken by members
of WEA and the requirements which must be met for that action to be
protected. (4)

(a) Nature of the action and requirements for protection (4 marks)

Nature of the Action

The action taken by the members of WEA is a secondary strike (also called a sympathy strike).

A secondary strike occurs when employees strike in support of workers employed by another
employer who are involved in their own primary dispute. In this case:

 Employees of Red Wood (RW) stopped working,
 Not because of their own dispute,
 But in support of employees of Furniture Manufacturers (FM).

This type of strike is recognised under the Labour Relations Act 66 of 1995.



Requirements for a Protected Secondary Strike

For the secondary strike to be protected, the following requirements must be met (section 66 of
the LRA):

1. The primary strike must be protected
o The strike by FM employees must comply with legal requirements (e.g. referral to
CCMA, certificate of non-resolution, notice).
