Mr Simpson was 45 years old when she married Mr Simpson, who was 65 years old at the time. Mrs Simpson never worked during the marriage, as Mr Simpson believed that a woman’s place is in the home. After 15 years of marriage, Mr Simpson died and bequeathed the whole of his estate to his three children from his previous marriage. Mrs Simpson has no assets or income of her own but does not want to claim redistribution of assets from Mr Simpson’s estate. Advise Mrs Simpson whether she has any other claim as a surviving spouse against Mr Simpson’s deceased estate.

Mrs Xitsonga’s customary marriage is legally recognised. The marriage was
concluded on 13 March 1999, which was before the Recognition of Customary
Marriages Act 120 of 1998 came into operation on 15 November 2000. A customary
marriage that was valid under customary law and existed when the Act commenced
is recognised as a marriage for all legal purposes.1The fact that the marriage was
never registered does not by itself make it invalid because registration mainly
provides official proof of the marriage, while non-registration does not destroy an
otherwise valid customary marriage.1
