Collective bargaining remains one of the most important mechanisms through which employees and employers regulate wages and conditions of employment. Trade unions often conclude collective agreements with employers on behalf of their members. In certain circumstances, collective agreements may also affect employees who are not parties to the agreement. This raises questions regarding the extent to which collective agreements may bind minority trade unions, non-unionised employees, or employees represented by different trade unions. The employer is uncertain about the legal consequences of the various collective agreements and the status of the strike.
