Legal Aid South Africa applies the means test to determine whether a person
qualifies for legal assistance. The purpose of this test is to assess whether the
applicant can afford private legal representation. Legal aid is granted primarily to
individuals who do not have sufficient financial resources to secure legal services on
their own.
The means test evaluates the applicant’s total monthly income, including salary,
wages, or other sources of earnings. It also considers assets such as property,
savings, or investments. In addition, Legal Aid South Africa assesses the applicant’s
financial responsibilities, including the number of dependants and existing financial
obligations. Social grant income may also be taken into account. If the applicant’s
income and assets fall below the prescribed threshold, they qualify for legal
assistance. If they exceed the limit, they may be required to contribute towards costs
or may not qualify.
