Florida responded to the medical malpractice crisis through reforms and legislative changes. The first
was the 1985 Comprehensive Medical Malpractice Reform Act, which added steps that must be taken
before filing a malpractice lawsuit. The first requirement is that you must provide notice of intent to
the person/practice you are suing. The second is you much engage in pre-suit discovery. Pre-suit
discovery encourages parties to settle before going to court over a 90-day period. It allows the
practice to conduct their own investigation in order to decide whether they should settle or take it to
trial.
The second response is the 2003 Medical Malpractice legislative changes, which put caps on non-
economic damages, caps on damages in the emergency room, and narrowed who is considered an
