Introduction

The consolidation of erven refers to the legal process by which two or
more separate pieces of land are merged into one single property,
resulting in the cancellation of the original separate titles and the issue of
a new title deed for the consolidated erf. While consolidation may
appear to be a straightforward land survey and registration procedure, it
becomes more legally complex when one of the properties is burdened
by a real right, such as a mortgage bond.

In this case, Zanele Khumalo owns Erf 3 and Erf 4 in Kruger Township
and wishes to consolidate them into one property. However, Erf 3 is
subject to a mortgage bond registered in favour of Blue Bank. A
mortgage bond is a limited real right registered over property as security
for a debt. Because consolidation alters the legal identity of the land, the
bond cannot simply remain as it is. Zanele must therefore address the
bond properly through legally recognised conveyancing procedures to
