Legislative intent 486.015 - answer Ensure that every physical therapy practitioner
practicing in this state meets minimum requirements for safe practice.
Physical therapy practitioners who fall below minimum competency or who otherwise
present a danger to the public will be prohibited from practicing in this state.
Legislative intent 456.003 entitles - answer Persons desiring to engage in any lawful
profession regulated by the department shall be entitled to do so as a matter of right if
otherwise qualified.
Legislative intent 456.003 regulations occur when - answerSuch professions shall be
regulated only for the preservation of the health, safety, and welfare of the public under
the police powers of the state such as:
- unregulated practice can harm or endanger the health, safety, and welfare of the
public and when the potential for such harm is recognizable and clearly outweighs any
anticompetitive impact which may result from regulation
- the public is not effectively protected by other means, including, but not limited to,
other state statutes, local ordinances, or federal legislation
- less restrictive means of regulation are not available
Legislative intent 456.003 use of the term "profession" - answerwith respect to those
activities licensed and regulated by the department shall not be deemed to mean that
such activities are not occupations for other purposes in state or federal law.
Legislative intent 456.003 neither the department nor any board may - answer**MAY
NOT**
- create unreasonably restrictive and extraordinary standards that deter qualified
persons from entering the various professions
- take action that creates or maintains an economic condition that reasonably restricts
competition except as provided by law
- create a regulation that has an unreasonable effect on job creation or retention in the
state or places unreasonable restrictions on the ability of individuals who seek to
practice or who are practicing a profession or occupation to find employment.
Legislative intent 456.003 shall evaluate proposals to - answer- increase regulation of
regulated professions or occupations to determine the effect of increased regulation on
job creation or retention and employment opportunities.
,Legislative Intent 456.003 policies shall ensure - answerPolicies shall ensure all
expenditures are made in the most cost-effective manner to maximize competition,
minimize licensure costs, maximize public access to meetings conducted for purpose of
federal regulation. Long-range planning shall be implemented to facilitated effective
operations, eliminate inefficiencies.
Legislative Intent 456.003 does not include - answerEnlargement, modification, or
contravention of the lawful scope of practice of the profession regulated by the boards.
This subsection shall not prohibit the boards, or the department when there is no board,
from taking disciplinary action or issuing a declaratory statement.
"physical therapy" or "physiotherapy" 486.021(8) - answer- health care profession
- terms are deemed identical and interchangeable with each other
"practice of physical therapy" 486.021(11) - answer- performance of physical therapy
assessments and the treatment, prevention, rehabilitation of such disability, injury,
disease, or other health condition by alleviating impairments, functional movement
limitations, and disabilities by designing, implementing, and modifying treatment
interventions through therapeutic exercise
- functional movement training in self-management and in-home, community, or work
integration or reintegration
- manual therapy
- massage
- airway clearance techniques
- maintaining and restoring the integumentary system and wound care
- physical agent or modality
- mechanical or electrotherapeutic modality
- patient-related instruction
- the use of apparatus and equipment in the application of such treatment, prevention,
or rehabilitation
- the performance of tests of neuromuscular functions as an aid to the diagnosis or
treatment of any human condition
- the performance of electromyography as an aid to the diagnosis of any human
condition only upon compliance with criteria set forth by the Board of Medicine
plan of care in practice of physical therapy 486.021(11) - answer- physical therapist may
implement for a patient by a practitioner of record or by APRN
- must refer to or consult with practitioner of record if condition is to be found outside of
scope of PT
- if treatment is required beyond 30 days for a condition not previously assessed by
practitioner of record, PT shall have a practitioner of record review and sign the plan;
does not apply when a patient has been physically examined by a physician licensed in
another state and has been diagnosed with condition for which physical therapy is
required
, direct access practice of physical therapy 486.021(11) - answer- 30 days
- if treatment is required beyond 30 days for a condition not previously assessed by
practitioner of record, PT shall have a practitioner of record review and sign the plan
- 30 day limit DOES NOT apply when a patient has been physically examined by a
physician licensed in another state and has been diagnosed with condition for which
physical therapy is required
- practitioners of record may include: medical, osteopath, chiropractic, podiatric,
dentistry practitioners actively engaged in practice
use of roentgen rays and radium practice of physical therapy 486.021(11) - answer- use
of roentgen rays and radium for diagnostic and therapeutic purposes and the use of
electricity for surgical purposes, including cauterization, are not "physical therapy"
chiropractic medicine, spinal manipulation, or acupuncture in practice of physical
therapy 486.021(11) - answer- not authorized to practice chiropractic medicine as
defined in chapter 460, including specific spinal manipulation, or acupuncture as defined
in chapter 457.
patients treating in hospital facilities in practice of physical therapy 486.021(11) -
answer- not authorized to implement a plan of treatment for a patient currently being
treated in a hospital facility.
"physical therapist" 486.021(5) - answer- person who is licensed and who practices
physical therapy in accordance with the provisions of this chapter.
"physical therapist assistant" 486.021(6) - answer- person who is licensed in
accordance with the provisions of this chapter to perform patient-related activities,
including use of physical agents, whose license is in good standing, and whose
activities are performed under the direction of a physical therapist as set forth in the
rules adopted pursuant to this chapter.
- patient related activities performed by a PTA for a board certified orthopedic physician,
physiatrist, or chiropractor shall be under the general supervision of a physical therapist,
but shall not require onsite supervision by a physical therapist.
- patient related activities performed for all other health care practitioners licensed under
the medical, osteopathic, podiatry, or dental practice must be performed under onsite
supervision of PT
"physical therapy practitioner" 486.021(7) - answer- physical therapist or physical
therapist assistant who is licensed and who practices physical therapy in accordance
with the provisions of this chapter.
"unlicensed personnel" 64B17.6.001(1)(i) - answer- any individual, working, or
volunteering in a physical therapy setting, not holding a current license as a physical
therapist or physical therapy assistant.
