Legislation that outlines the process for the assessment, treatment, and rights of
individuals with mental health disorders who may require involuntary care
What is the purpose and function of Form 1 (Admission Certificate) under the
Mental Health Act?
When a patient is brought in, two physicians (one of which must be a psychiatrist)
must assess the patient independently within 24 hours of entry to emerg.
If both physicians sign a Form 1, the individual can be held in a designated facility for
up to a month for further assessment. (Transferred from emerg to the psych unit)

How long do designated site vs non-designated site have to sign the two Form
1's required to hold a patient?

Non-designated sites have 72 hours to sign the two From 1's, this is because the
site will have to transfer (converge) the patient to a designated site. Requiring more
time (E.g. Rural sites)
Designated sites only have 24 hours to sign the two From 1's (E.g. Royal Alex,
Grey Nuns, Alberta Hospital)
What criteria must the patient meet for Form 1 and 2 to be considered valid?
The person is:
1. Suffering from mental disorder
2. Has the potential to benefit from treatment for a mental disorder
3. Within a reasonable time, they are likely to cause harm to others or to suffer
negative effects, including substantial mental or physical deterioration or serious
physical impairment, as a result of or related to the mental disorder
4. Unsuitable for admission to a facility other than as a formal patient
All criteria must be met and based on the facts outlined in the form
What is the purpose and function of Form 2 (Renewal Certificate) under the
Mental Health Act?
A certificate of renewal
If two Form 2s are completed by two independent physicians, the patient can be
held for additional months
How many times can a Form 2 be renewed?
Can renew the certification monthly, up to a maximum of 3 renewals
The first and second renewals will hold the patient for one additional month each.
While the third renewal will result in the patient being held for an additional 6 months
Which medical professionals are involved in the renewal certification process?
At least one of the health professionals must be a:

to a Facility) under the Mental Health Act?
A warrant to return an escaped/run away patient. However, this only applies
to certified (involuntary) patients
Can Form 3 be issued for voluntary patients?
If a voluntary patient escapes you CANNOT use a Form 3 to apprehend them,
as Form 3's are only valid for certificated patients.
