This document is a legal and ethical analysis of a complex safeguarding case scenario involving a family in the UK, demonstrating the application of various UK Legislations, case laws, and social work policies. The core purpose is to show how social workers apply the law to address domestic abuse, child safeguarding risks, and family dilemmas. Case Scenario The analysis centers on the case of a 14-year-old boy, Amir, who is involved in a conflict with his father that escalates to him holding a knife. His older sister, Agita, has already left home due to a refusal of an arranged marriage, and the younger sister, Alayna, is also in the home. The scenario presents a high-risk situation involving coercive control and domestic abuse. Legal and Policy Application The paper dissects the scenario by applying specific UK legislation and principles to determine the necessary interventions: The Children Act 1989: The primary legal framework for assessing children's welfare, prioritizing the Paramountcy Principle (the child's welfare is the court's first and paramount consideration). Human Rights Act 1998 (HRA): Used to guide the balance between the family's right to private and family life (Article 8) and the need for public protection and intervention. The Care Act 2014: Applicable to the adult victims (the mother and Agita), ensuring their needs are met, particularly regarding protection from domestic abuse and coercive control. Case Law (e.g., Re H 1996): Used to support the legal interpretation of parental rights and the state's right to interfere.

Law, Rights and Safeguarding (Children’s Scenario)

Introduction

The UK legislation, laws and policies have been leveraged to promote a deeper

understanding of domestic abuse and violence, whereby children and adult victims are

challenged. Implementing these elements requires effective collaboration and multiagency

working to help safeguard and protect the individuals. These factors should be implemented

across all care sectors, including social workers. Children and adults often experience abuse,

neglect, and other perpetrations. Therefore, it is crucial to apply the relevant laws, statutory

and legal interventions when addressing family and children’s cases in the United Kingdom.

They are also highly relevant in determining the right approach when dealing with dilemmas

and the tensions in the social work profession. This case study will therefore draw on the

laws and policies in social work practice, while also using the tensions and dilemmas relevant

to the practice to demonstrate a deeper understanding of the elements and how they can be

applied.

Case Study

The case pertains to a 14-year-old Amir who attends the Oxford Road Grammar

School. He is the second-born, with his first-born sister, Agita, who is already 19 and has

moved out of the home due to conflicts with their father after she refused to agree to an

arranged marriage. Third, Alayna, 6, and fourth, born Arifa, 4, live with them. The mother

left 6 months ago due to domestic abuse, but the father, Mr. Khan, explains that she moved

out because of Amir’s behavioural issues. Mrs. Mullins reported signs of physical abuse,

evident with bruises on Amir’s left thigh. The father was seen dragging Amir by hand, hitting

and slamming Amir’s head on the car.
