Scenario 1: Lori and Brian

Charges: Assault, Battery, and Murder

Assault: In West Virginia, assault is defined as an attempt to commit a violent injury to
another person or an act that places another person in reasonable apprehension of
immediate physical harm. Brian’s act of jumping in front of Lori and pointing a knife at her
face constitutes assault.

Battery: Battery involves the unlawful application of force to another person. Brian striking
Lori fulfills the elements of battery.

Murder: For a murder charge, the prosecution must prove that Brian’s actions directly led
to Lori’s death and that he had the requisite intent. In West Virginia, murder can be
classified into different degrees:

- First-degree murder: Requires premeditation and intent to kill.
