The issue is whether Rachel R’s live sign language renditions of Luke’s song She saw
me first at The Picks’ concerts require Luke’s authorisation under South African
copyright law. Luke, as the original composer and lyricist, holds copyright in both the
musical and literary elements of the work in terms of section 2 of the Copyright Act 98 of
1978. As author, he enjoys exclusive rights to reproduce, adapt and perform the work in
public. 1 Although The Picks obtained a licence to perform the song, Rachel’s
contribution raises the further question of whether her interpretations constitute a
separate use falling within Luke’s exclusive rights.
