ASSIGNMENT QUESTION
Bakery Workers Association (‘BWA’) is a registered trade union which represents
some employees within Biscuit Bakery (Pty) Ltd (‘BB’). BWA approaches BB to
acquire various organisational rights within the workplace. Describe various
methods which BWA may use to acquire organisational rights within BB.
In broad terms the LRA grants registered trade unions specific organisational rights in a
workplace so they can function effectively.
The main rights are:
Access to the employer’s premises (to recruit, hold meetings outside work hours,
communicate with members, run ballots, etc.).
Stop-order / deduction of union subscriptions from wages (so the employer deducts
members’ subscriptions and pays them to BWA).
Election of shop stewards (and recognition of those stewards to represent employees).
Paid time off for shop stewards / members to perform union functions (reasonable time
during working hours).
