persistent soil erosion resulting in the delivery of sediment onto neighboring properties or into state
waters.

· Does not apply to any lot or parcel of land of 10,000 square feet or less used for residential purposes or
to shorelines where the erosion results from wave action or other coastal processes.



Erosion and Sediment Control (ESC or E&SC) Plan - Answer: · Describes the potential for erosion and
sedimentation during a LDA

· Describes the structural and non-structural practices for minimizing erosion and containing sediment
during construction.

· Must review an adequate ESC plan and grant written approval within 60 days.

· If no action is taken within allotted time, plan is deemed approved
