A1: FEDERAL AND STATE PUBLIC HEALTHCARE POLICIES
Federal Policy:
HITECH Act, enacted in 2009, objects to promoting the implementation of health
information technology, that is, electronic health records (EHRs), to strengthen the provision of
care. It promotes the adoption of EHRs among healthcare providers, and it also provides for the
enforcement of penalties in the event of non-compliance.
State Policy: California's End of Life Option Act (EOLOA)
California has signed into law what is known as the 'End of Life Option Act' allowing
any adult patient with a terminal illness to request for and receive a prescription that will end
their life. It enables patients to make an informed decision for their treatment without
compromising on the regulatory measures.

Federal Policy: HITECH Act
The HITECH Act operates on the principles of federal enticements and penalties for the
implementation and meaningful use of EHRs among providers. This law is administered by
Office of the National Coordinator for Health Information Technology (ONC) and compliance is
checked through penalty for non-compliance with the EHR standards.
State Policy: California EOLOA
The EOLOA requires that only patients with a diagnosis of terminal illness should be
given the medication after meeting the eligibility criteria, including mental competence, two
verbal requests, and one written request for the medication. Healthcare providers are not under
legal compulsion to participate in it, but if they do, they have to report and document according
