The Mine Health and Safety Act 29 of 1996 (MHSA) is the primary legislation governing
health and safety in mines in South Africa. It places a duty on mine owners to ensure that their
operations do not pose risks to workers and the surrounding community, even when a mine is
no longer actively worked.

According to Section 2 of the MHSA, the employer of a mine, whether operational or
abandoned, retains legal responsibility for health and safety measures until a formal closure
certificate is issued by the Department of Mineral Resources and Energy (DMRE). This
means that an employer must continue fulfilling safety obligations, even if mining activities
have ceased.
