due to the introduction of alcohol, a controlled substance, a drug, a dangerous
drug, a combination of two or more of such drugs, or having an alcohol
concentration of 0.08 or higher.
Public Intoxication – ANSWER appears in a public area when inebriated to the
point where the person may jeopardize the individual or another.
Criminal Negligence - ANSWER A person fails to reach a normal level of care
that an ordinary person would meet under these situations; for example,
checking ID, calculating age, and looking for indicators of intoxication.
Safe Harbor - If an illegal sale is made, the seller-server may be arrested, but the
company's permit/license may be protected.
How long is the seller-service certification valid? - Answer: two years.
What are the exceptions for children with alcohol? - ANSWER: Minors may
possess alcohol when working, in the presence of a legal guardian, or while
assisting police officers in enforcing the alcoholic beverage code.
