Assignment 1 Semester 2 2024
QUESTION 1
(a)
In this scenario, Mrs. M is unable to seek assistance from the Road Accident Fund
(RAF) to cover the expenses of repairing the damages to the boundary wall of her
property. The Road Accident Fund (RAF) offers compensation exclusively for personal
injuries arising from motor vehicle accidents, without any coverage for property
damage.
The Road Accident Fund (RAF) provides coverage for the following:
1. Medical expenses: Expenses related to medical care for injuries resulting from
the accident.
2. General damages: Compensation for pain and suffering is only granted if the
harm is severe, resulting in deformity, mental disability, or loss of physiological
function.
3. Loss of earnings: Reimbursement for lost wages incurred as a consequence
of the injury, which prevented the individual from working.
Nevertheless, the RAF does not provide coverage for any harm or destruction to
property. Property harm, such as the damage to Mrs. M's boundary wall, must be
pursued through another legal channel. Mrs. M should file a claim against Mr. Deen
Ros personally to seek reimbursement for the expenses incurred in repairing the wall.
