Florida Laws & Rules Exam for Psychologists Board of Psychology Members Seven people appointed by governor and confirmed by the Senate. Five members must be psychologists licensed in Florida who are in good standing. Two members must be citizens of the state who are not and have never been psychologists. No connection to psychology. One member must be 60+ y/o. Appointed for four years and shall serve until their successors are appointed. Licensure Requirements 1) Doctoral-level psychological education or the equivalent from another country. Applicant has burden to prove 2) 2 years or 4,000 hours of experience in the field under the supervision of a licensed psychologist 3) Passed the examination. School Psychologist Licensure 1) Doctorate, Specialist, or Equivalent degree from a program primarily psychological in nature. 60 semester hours or 90 quarter hours of graduate study. Council for Higher Education Accreditation or Association of Universities and Colleges of Canada. 2) Minimum of 3 years experience in school psychology, 2 of which must be supervised by an individual who is a licensed school psychologists Doctoral internship may be applied to this 3) Passed an examination Licensure Application Fees Psychologist- not to exceed 500 School Psychologist- not to exceed 250 Closing Application Board will close application of someone who fails to pass licensure examination and the florida laws and rules or who fails to submit evidence of completion of postdoc within 24 months. Provisional Licensure 1) Completed application form and fee of no more than 250 2) Earned a doctoral degree in psychology 3) Met any additional requirements established by board 4) Must work under the supervision of licensed psychologist until the licensee is in receipt of a license or letter Provisional license expires 24 months after date of issue. Licensure by Endorsement 1) Is diplomate in good standing with the American Board of Professional Psychology 2) Possesses a doctoral degree in psychology and has at least 10 years of experience as a licensed psychologist in the USA within the 25 years predating application 3) Must pass Florida Laws and Rules 4) Cannot issue this to someone under investigation until investigation is complete Renewal of License Biennial renewal of a license with fee not to exceed 500 Must present evidence of CEs not to exceed 25 hours per year Continuing Education Providers must be approved by board/department Board has authority to set a fee not to exceed 500 for each applicant who applies for or renews provider status. Such fees are deposited into the Medical Quality Insurance Trust Fund Proof of completion must be submitted in a manner and time specified Disciplinary Causes Pt 1 1) Getting a license through bribery, fraudulent misrepresentation or error 2) Having another license revoked, suspended, or otherwise acted against 3) Being convicted or found guilty of a crime which directly relates to the practice of the profession 4) False, deceptive, or misleading advertising/fee/value 5) Trying to practice under a different name 6) Maintaining a professional association with someone who is in violation of the laws 7) Helping an unlicensed person pretend to be licensed 8) Failing to perform any legal obligation required 9) Willfully making/filing a false report or record 10) Paying/receiving kickbacks, bonuses, etc for referring clients 11) Sexual battery on a client 12) Making misleading representations of psychologists Disciplinary Causes Pt. 2 13) Soliciting patients through fraud, intimidation, etc. 14) Failing to make available to client copies of stuff that have been paid for 15) Failing to respond within 30 days to DOH communications concerning investigations 16) Being unable to practice as a result of mental/physical condition of drugs. 17) Performing treatment which constitutes experimentation on human subjects without informed written consent 18) Failing to meet minimum standards of performance in professional activities 19) Delegating professional responsibilities to a person who is not qualified 20) Violating a rule relating tot he regulation of the professional 21) Failing to maintain in confidence a communication made by patient/client 22) Making public statements which are derived from data and which identify or damage subjects/ clients 23) Violating any provision of this chapter or chapter 456. Inability to Practice Due to Mental/Physical Condition If probably cause exists to believe that licensee cannot practice effectively, they have the authority to compel person to submit to a mental or physical examination by psychologists or physician. If you refuse to participate, you may file a petition for enforcement in circuit court. You will be afford privacy (no names, public proceeding). Afforded opportunity at reasonable intervals to demonstrate that you can return to competent practice Terms you cannot use unless licensed "psychologist", "school psychologist", "psychology", "psychological" "psychodiagnostic", "psychotherapy" (unless certified psychiatric ARNP) License/Provisional License Must be conspicuously displayed as valid, active at each location where psychologist practices. "Licensed Psychologist"/"Provisional Psychologist Licensee" Must be used in all professional advertisements, promotion materials, etc. Professional Title Violations Section 1) = misdemeanor of first degree Section 2 and 3= disciplinary action Juvenile Sexual Offender Therapy Cannot practice unless person holds active license, and meets the requirements to practice. Unlicensed person may practice under supervision Licensed School Psycholoogists Can practice private sector services while employed by a school if: 1) Adult is informed in writing of their eligibility for free district services 2) Client is not a student of the schools to which psychologist is assigned 3) Adult is informed that as dual practitioner, cannot serve as an independent evaluator 4) Does not promise 24 service or on call services. Does not engage in private practice during employment hours 5) Does not use position within school to offer private services 6) Does not utilize materials belonging to school Exemptions 1) Does not apply to physicians unless they're using protected professional titles 2) Does not apply to nursing, clinical social work, marriage and family therapy, mental health counseling, unless using protected titles Exemptions from Licensure 1) Employees of certain agencies if person is performing duties they were trained to do, and as long as they are not marketed as psychologists 2) Salaried employee of nonprofit organizations providing counseling services, if they are without charge, and no one is saying they're a psychologist 3) Student who is pursuing study who is providing services in a training setting. Must use designated titles like intern or trainee to indicate student status 4) Certified in school psychology by department of education and is performing services as employee of public or private educational institutions. Non-Resident Offering Services Exception 1) Services are performed for no more than 5 days per month, or 15 days in a year 2) Licensed or certified by another state/country whose standards are equivalent or higher than FL. Other Exceptions 1) Is rabbi, priest, minister while engaging in ministerial duties as part of an established/legally cognizable church. 2) Practices solely behavior analysis 3) Exemptions do not apply to any person whose license has been suspended/revoked. Hypnosis Practice Licensed psychologists may practice. Statute does not apply to others who may practice for nontherapeutic purposes so long as they do not say they're licensed under this chapter.
