D431: Investigative Plan of Action
A:
1. STRATEGY TEAM WILL USE
The team will take on a strategic approach to collect all evidence related to the investigation. It
will be discreet, and it will not hinder business operations. Strategies include:
Undisclosed Investigation:
*Secret Operation: The team will investigate the suspect discreetly. This will help prevent
tipping off the suspect and other employees who may be involved.
*Minimize Access: All information/evidence pertaining to the investigation will only be
available to stakeholders and team members essential to the investigation.
*Gather information silently: No one outside of senior management and the team, will
know that an active investigation is taking place. The gathering of evidence will not
disrupt normal business operations, nor will it raise suspicion
Targeted Evidence Gathering:
*Specified Data Gathering: The team will identify all areas/equipment specific to the
suspected employee. This includes the employee's work computer, emails, and
any related servers to avoid unnecessary invasion.
*Continuity of Business Operations: The team will collect evidence/information when
the business is closed. This will eliminate any chance of interference with daily
operations.
Legally Complying:
*Adhering to legal processes/procedures: The team will ensure the collection
of evidence is ethical and complies with the standards set legally. This ensures the
evidence found/presented is admissible in a court setting if necessary.
*Consulting with the Legality team: The investigation team will work closely with
the legal office. This serves as a way to validate actions taken during the investigation
process and grants the necessary approvals.
, Privacy Considerations for Employees:
*Decisive Gathering of Information: The team will only gather evidence that is relevant
to the suspect and the investigation. This eliminates all possibilities of the employee's
privacy being invaded unnecessarily.
*Minimizing the Data: The team will narrow down the scope for data collection.
This allows the focus to shift directly to the evidence that supports the claim of policy
violation.
Responding Proactively:
*Timely Responses and Executions: The team will step in immediately to resolve any
misinformation or evidence of a cover-up if brought on by the suspect.
*Implementing Control Measures: The team will enact containment measures to
eliminate the possibility of proprietary information being disseminated.
Employee Training/Education:
*Employee Awareness Seminars: Awareness seminars should be conducted regularly to
help inform/educate employees. The seminars should stress the importance of adhering
to company policies with a big emphasis on how it relates to proprietary information.
*Training Initiatives: Training programs should highlight the importance of NDAs and
AUPs. Training should occur on a consistent basis.
Full Reporting and Documenting:
*Detailed Documentation: The team will uphold/maintain detailed documentation of
the entire process taken. The documentation will be transparent and comprehensive.
*Reporting Regularly: The team will be consistent in providing periodic updates to the
legal office and to higher ups in management.
