I. Acknowledgments vs. Affidavits
Acknowledgment
 Definition: A formal declaration made before an authorized public officer
(such as a notary public) by an individual who has signed a document. The
signer declares that they executed the instrument voluntarily and of their
own free will.
 Conflict of Interest Rule: A notary public must never take an
acknowledgment for an instrument in which they have a personal financial
or beneficial interest. Doing so invalidates the notarization.
Affidavit

 Legal Nature (Ex Parte): An affidavit is considered an ex parte

Forgery in the Second Degree
 The Rule on False Certificates: Under New York State Penal Law, any
notary public who knowingly creates, signs, or issues a false notarial

criminal offense carrying significant prison time.
Affirmation
