"Communication Technology"
Definition: An electronic system, device, or process that fulfills two key
conditions:
1. It enables a commissioned notary public and a physically distant,
remotely located signer to interact and communicate with each other
in real-time via simultaneous, two-way audio and video (sight and
sound).
2. When required by law or necessity, it incorporates features that assist
and facilitate communication with a remotely located individual who
has a speech, hearing, or vision impairment.
"Electronic Record"
Definition: Any data or information that is created, generated, sent,
communicated, received, or digitally preserved using electronic,
electromagnetic, optical, or digital means (as opposed to physical ink and
paper).
"Electronic Notarial Act"
Definition: An official act of state performed by a notary public on or
involving an electronic record, utilizing digital technologies and methods
approved by the New York Secretary of State.
NYS Exam Landmark Rule: The performing notary public must be physically
located within the boundaries of the State of New York at the exact moment the
electronic notarization is conducted, even though the signer may be located
anywhere else in the world.
