1.1 (5 Marks)

In terms of Section 41 of the Constitution of the Republic of South Africa, 1996, the
following are five principles of cooperative government:

1. Government in all spheres must preserve the peace, national unity, and the
indivisibility of the Republic.
2. Government must secure the well-being of the people of the Republic.
3. All spheres of government must provide effective, transparent, accountable, and
coherent government for the Republic as a whole.
4. Each sphere of government must respect the constitutional status, institutions, powers,
and functions of government in the other spheres.
5. All spheres of government must cooperate with one another in mutual trust and good
faith by assisting and supporting one another, coordinating their actions, sharing
information, and avoiding legal proceedings against one another where possible.

The Public Protector is an independent institution established under Chapter 9 of the
Constitution of the Republic of South Africa, 1996 to support and strengthen constitutional
democracy. Its primary role is to investigate complaints of improper conduct,
maladministration, abuse of power, or unlawful actions by state institutions and public
officials. The Public Protector may investigate matters on receipt of a complaint or on its
own initiative, report on its findings, and recommend appropriate remedial action. The
institution also promotes accountability, transparency, and good governance in the public
