An oath is a spoken pledge, given by a person appearing before the Notary for
truthfulness of a specific statement(s) and/or a specific performance of a specific duty or
function.
What is an Affirmation
may be given if a persons has conscientious objections against taking an oath.
How much may you charge for an Oath or Affirmation?
, No more than $2.50. With no fee for swearing in a person.
Example of an Oath.
"Do you swear that the information presented in this document entitles "ABC", which
you have signed before me, is the truth, so help you god?"
Example of an Affirmation.
"Do you solemnly affirm that the information presented in this document entitled "ABC",
which you have signed before me, is the truth, and this you affirm under the pains and
penalties of perjury?"
How can an oath and affirmation be formalized?
By raising the right hand and/or placing it on any holy book.
What does an acknowledgment formally document?
That the signer of a document appeared before the Notary
That the Notary positively identified the signer
That the signer both acknowledge the signature as theirs, and that the signatures was
made willingly
Requirements for Taking an Acknowledgement
Ensures signer appears before them with at least one form of ID which provides a
physical description of signer (ie Drivers licenses). Not needed if notary personally
knows signer or there is a witness to also identify the signer
Ensures that the document is filled in completely. Not a legal review but instead for
completeness. If there are blanks signer must place an X or strike through the blank
Ensures that the signer understands the title and is signing willingly and freely. Notary
may ask basic questions of the substance of the document to ensure these are correct.
Must be signed, dated and stamped (Stamp must include the the expiration date of
commission. If they do not have a stamp, the must write his or hers commission
expiration date)
Must make a journal entry
