QUESTION 1: THE LEGAL PROFESSION

1.1 Discuss the following statement:
“Legal ethics can be understood in a wide and a narrow sense.” (5)

“Legal ethics” can be understood in a broader (wide) and a narrow sense.
In legal practice the term “legal ethics” is understandably generally used in its
narrow sense.
In the narrow sense, the term refers to the ethical standards of professional conduct
applicable to the field of law (as opposed to the field of medicine, for example, in which
case we would speak of “medical ethics” to refer to the professional conduct required
of medical practitioners). Legal ethics in the narrow sense therefore deals with the
“ought’s” of providing legal services: “How ought a legal practitioner to behave in order
to be a good, decent and proper legal practitioner?”
In the wide sense, it refers in general to the relationship between law and ethics (or
morality). For example: May the law be used to enforce moral views on abortion,
homosexuality, prostitution or human cloning?1

discipline, reflecting the unique demands of each field.6.1. Challenges in Business ExamsOne of the primary challenges in business exams is the need to balance theoretical understanding with practical application. Many
business exams, especially those based on case studies, require students to analyze complex scenarios with limited information. Students often struggle with formulating a strategic approach or making decisions based on
incomplete data, as business problems in the real world rarely have

1.2 Read the following scenario and answer the questions that follow:
Jimmy has just completed his LLB degree, and he is now working as a candidate
attorney at a big law firm in Pretoria. One Saturday morning, Jimmy and his mother,
who is a nurse, discuss their respective professions and how they are being regulated.
Jimmy tells his mother that he (Jimmy), as a candidate attorney, is suspicious of codes
of ethics. Jimmy’s younger sister, Annie, who is a first-year medical student, asks him
what a professional code is.
(a) Explain what a professional code is and list any three general aims of a code
of legal ethics. (5)
A professional code of ethics suggests a compilation of ethical values to provide legal
practitioners with an ethical framework to provide ethical practice of law. The general
aim of the code seeks to:
• Protect professional nature of legal services by stressing obligation of professional
to serve justice and the public;
• Correct imbalance in relationship between professional and client;
• Maintain public confidence;

Jimmy, as a legal practitioner, expresses his concerns as a so - called “insider”. As an
insider, Jimmy’s concerns to two main aspects namely:
Practical concerns:
- Professional codes not always enforced;
- Those who transgress the codes aren’t always dealt with effectively;
- Since practitioners feel transgressions not always dealt with properly, they argue to
abandon or replace them with codes of business ethics;
- Peer pressure not to follow the code;
- Fear of losing clients when encouraged to do the right thing.
Theoretical concerns:
- Idea of practicing law counters idea that legal ethics can be reduced to rules of
professional conduct;
- Self-regulation of the profession requires complex professional judgment, the
reasonableness of which can be judged only be fellow practitioners;
- Self-regulation presumes conduct of practitioner will not be judged against code, but
by colleagues who exhibit virtues of morally good practitioners;
1.3 Briefly explain the meaning of Kronman’s idea of “public spiritedness” as a
character trait of the good lawyer. (2)

The character trait of public spiritedness means you choose law as a commitment to
public good and practice law as an instrument to promote and protect public good.
Kronman makes 3 points to prescribe to notion of “public good”
• Failure of public spiritedness is an inability to recognise your status should promote
and protect public good;
• Being involved in politics, not contri boni mores, is working towards public good;
• Choosing legal profession purely for public spiritedness is an instrument toward
public good.
