(a) Discuss whether it is appropriate for Mr. XT to use an action or application
procedure.
Prosecutorial bail refers to bail granted by a prosecutor before the accused appears in
court. In terms of the Criminal Procedure Act 51 of 1977, this form of bail is generally
limited to less serious offences. Arson, however, is considered a serious offence due to
the potential danger to life and property.
In this case, Allan Fuse is accused of setting fire to a building in the Johannesburg CBD,
resulting in extensive damage. Although no one was injured, the seriousness of the
offence and the public interest involved make it unlikely that prosecutorial bail would be
appropriate. Prosecutors typically do not grant bail in serious offences where the
interests of justice may be affected.
Therefore, Allan Fuse would most likely need to apply for bail in court rather than
through prosecutorial bail.1
