1. Describe the principles behind the constitutionally guaranteed right to a speedy trial.
What individual rights and protections are endangered by not being guaranteed a speedy trial?
The right to a speedy trial is guaranteed under the sixth amendment, the principles to the right of a
speedy trial under the sixth amendment is designed to maintain the integrity of the judicial system and
protect individuals from being incarcerated without evidence or conviction of a crime.
Failure to guarantee citizens their rights to a speedy trial would violate their due process rights
guaranteed under the fifth and fourteenth amendments.
2. Analyze the need to balance the right to a speedy trial with allowable legal strategies such as
requests for delays and continuances.
Did Ben’s attorney’s requests for a delay impact his speedy trial rights?
Balancing the right to a speedy trial while allowing legal strategies such as requests for delays and
continuances is important because it’s the legal justice system duty to make sure its citizens have an
accurate, fair and just trial. By allowing these legal strategies the courts can ensure that the prosecutor
and the defendant have the the time needed in order to gather and properly present their case. Ben’s
attorney’s request for a delay did impact his speedy trial rights because delays requested by the defense
is not considered a violation of them from the government.
