For the past eight months, he has held a valid Abnormal Loads Permit from the Provincial Department of Transport, authorizing him to transport abnormal loads to mines in Limpopo. His permit was issued out in terms of the National Road Traffic Act of 2008. Following a routine inspection, the Department informed Mr X by a letter that his permit has been revoked with immediate effect because it had received complaints alleging that some of his vehicles are not roadworthy. The letter did not specify the nature of the complaints, nor was Mr X allowed to respond before the decision was taken. As a result, Mr X can no longer deliver abnormal loads to his clients, his business operations have halted, and he has suffered significant financial losses. Mr X wants to challenge the Department’s decision under the Promotion of Administrative Justice Act 3 of 2000 (PAJA).
