In order for Amir to succeed in a delictual claim against Lalita, he must prove that all the
elements of delict are satisfied. One of the fundamental elements is conduct, which is
defined as a human act or omission that is legally attributable and can cause harm to
another (Du Plessis et al., 2020). Conduct may consist of either an act or an omission,
depending on whether the defendant failed to act when a legal duty required them to do
so (Hassim, 2019).
