Question:
Critically evaluate how the environmental legal framework relates to morals and societal
values. In your answer,
Explain how environmental law differs from other social norms (such as cultural
practices and ethical behaviour) and how the environmental legal framework, as
opposed to social norms, gives effect to the environmental right contained in
South Africa’s Constitution.
Environmental law in South Africa is closely connected to moral considerations and
societal values relating to sustainability, equity and responsibility towards present and
future generations. The increasing awareness of environmental degradation has led
society to recognise that environmental protection is not only a moral concern but also a
legal necessity. Environmental law has therefore emerged as a distinct field within the
South African legal system to regulate human interaction with the environment and to
ensure sustainable use of natural resources (Learning Unit 1: Introduction to
Environmental Law, pp. 1–2).
