Hoofdstuk 1

Voorbeelden uit de media (epigrafen)
• Jaffa Cakes: Rechtszaak over de vraag of Jaffa Cakes onder belastingwetgeving
als “cake” of als “biscuit” vallen. Cruciaal onderscheid: cakes verharden bij ouder
worden, biscuits worden zacht. Juridisch verschil: “cake” = essentieel voedsel,
vrijgesteld van btw; “biscuit” = luxeproduct, belastbaar.
• Harold Shipman: Huisarts veroordeeld tot levenslang voor de moord op 15
patiënten en het vervalsen van een testament. Bekend als grootste seriemoordenaar
in de Britse geschiedenis.
• Dan Brown en plagiaat: Auteurs van The Holy Blood and the Holy Grail
beschuldigden Dan Brown (auteur The Da Vinci Code) van plagiaat. Hof oordeelde
dat er geen sprake was van auteursrechtinbreuk, noch tekstueel noch inhoudelijk.
• Google-trademark: Tegenstanders beweerden dat “Google” generiek was
geworden (zoals “to google”), maar de rechter bevestigde dat het merk geldig en
beschermd bleef. Laat zien hoe bedrijven hun merk voortdurend moeten verdedigen
tegen “genericide”.
• Yorkshire Ripper-hoax: Opgenomen stem en brieven van vermeende moordenaar
bleken hoax. Forensische fonetici konden decennia later alsnog de dader
identificeren (John Humble, alias “Wearside Jack”) door vergelijking van oude
opnames met hedendaagse stemanalyses.

(bijv. cake vs. biscuit).
• Taalgebruik in moordzaken en rechtbankinteractie (Shipman-zaak).

• Eigendom van woorden en de juridische bescherming van merken (Google).

Hoofdstuk 3

The language of the law – kernpunten en casuïstiek

Ambiguïteit en conjuncties (‘and’ vs. ‘or’)
• Een Californisch strafrechtartikel koppelt twee vereisten met ‘and’ (onbekwaamheid
om de aard/kwaliteit van de handeling te begrijpen én onderscheid tussen goed en
kwaad).
• De rechter paste de bepaling letterlijk toe en achtte de verdachte niet krankzinnig,
omdat hij wél de aard/kwaliteit begreep.
• In hoger beroep is ‘and’ gelezen als ‘or’, met beroep op de traditionele insanity-
defence en wetgevende bedoeling: één criterium volstaat.
• Voorbeeld toont hoe één schakelwoord het uitkomstbereik van een norm ingrijpend
verandert.

Interpretatieregels in het common law
• Literal/plain meaning rule: hanteer de gewone, taalkundige betekenis.
• Golden rule: hanteer de gewone betekenis, tenzij dat tot ongerijmdheid of onrecht
leidt.
• Mischief rule: achterhaal het ‘kwaad’ dat de wet beoogt te verhelpen en interpreteer
dienovereenkomstig.
• Last antecedent rule: een beperkende bijzin slaat op het onmiddellijk voorafgaande
element, tenzij context anders vergt.

Casus: autoverzekering en ‘permission of the owner’
• Verzekeraar weigerde dekking: gebruik van andermans auto vereist toestemming
eigenaar.
• Verdediging beriep zich op last antecedent rule: toestemmingsvereiste geldt voor
“any other person or organization”, niet voor “the named insured”.
• Rechtbank volgde deze lezing; toont hoe syntaxis en reikwijdtebepaling
rechtsgevolgen sturen.

Casus: leraar, ‘felony’ en ‘moral turpitude’
• Ontslaggrond: “conviction of a felony or of any crime involving moral turpitude”.
• Hof past hier géén last antecedent rule toe, maar een regel dat een slotbepaling op
alle voorafgaande items slaat als dat contextueel logisch is.
• Conclusie: niet elke felony is er één “involving moral turpitude”; ontslag ongegrond.
• Twee ogenschijnlijk soortgelijke coördinaties leveren tegengestelde interpretatieve
uitkomsten op.

Belastingzaken over alledaagse producten (definitieproblematiek)
• Jaffa Cakes: grensgeval cake/biscuit. Elf kenmerken gewogen; meerderheid wijst
richting ‘cake’ → nul-tarief btw.
• Pringles: grensgeval crisp/non-crisp. Hoewel afwijkend van klassieke chips, toch
“voldoende vergelijkbaar” met crisps → standaard btw.
