Briefly explain the main difference between a criminal offence and a civil dispute
in South African law. (2 marks)
A criminal offence is a violation of public law where the State prosecutes an
accused person for conduct regarded as harmful to society (e.g., theft, assault).
A civil dispute arises between private parties (individuals, companies, or
organisations) where one party seeks to enforce a right or claim compensation
(e.g., breach of contract, damages).

Distinguish between the jurisdiction and roles of the Constitutional Court and the
Supreme Court of Appeal in South Africa. (3 marks)
The Constitutional Court is the highest court in constitutional matters. It deals
with cases involving the interpretation, protection, and enforcement of the
Constitution, including human rights issues. It also hears appeals where
constitutional issues are raised.
The Supreme Court of Appeal (SCA) is the highest court for all matters except
constitutional issues. It hears appeals on civil and criminal cases from the High
Courts and ensures uniformity in legal interpretation across the country.
